Homeless Disabled Veteran Vehicle Illegally Towed While it is certainly important for myself that I try to get my truck back, it was made obvious again to me today that MY efforts as a disabled homeless veteran put me in the thick of the larger battle. "Law enforcement" and tow companies" have systematically been taking vehicles and other belongings from those less fortunate and often homeless, because they can, and not because they should. Under federal law, as soon as I told the tow company I was living in that truck, they were obligated to release it to me. I was living and working out of that truck and had my stuff in that truck, and they didn't have the empathy and compassion to return it to me is from a "depraved-heart" in legal terms. Just heartless, otherwise, but depraved hearts have been covered in the US Code. It became a crime when they did not. BUT they know that most folks don't know enough and have enough time or energy to pursue the matter so eventually, they give up and move on with their lives, somehow.. The tow company finally sells it at auction, and for lack of a simple tow, a vehicle has been taken "under color of law". Remember that phrase, y'all. I am going to be using it a lot. Reason? Because all the crimes associated with my case and those of the class we are forming for a class action suit continue because they think they can "continue to get away with it", "under color of law". My thesis's heart is the notion of "allowed behavior". What is allowed, and what is not, whether specifically or by acquiesence, or a belief that a victim can't deal with it. In the case of government, law enforcement, and their agents such as tow companies, folks such as myself are dealing with folks that believe they have some right, even responsibility to do what they have done... BUT they can't legally make those judgments about themselves regarding actions they take that are addressed in the criminal and civil code, first at the federal level. The lower levels cannot usurp and supersede the federal law. I may not get my truck back, but I am in this fight that I need help to pursue and on behalf of thousands who do not have an adequate voice or advocate. This matter has kick-started Texas Foundation since it was always intended to help homeless veterans. I still need donations. Whether cash or saleable items of value.
